SMS Consent & Compliance

1. Program Description

Tavvi (operated by FornaxLink LLC) sends text messages to customers who explicitly opt in. Messages include:

  • Order status updates — Notifications when your order is received, being prepared, ready for pickup, or completed.
  • Order refund notifications — Confirmation when a refund has been processed for your order.
  • Rewards notifications — Alerts when you earn a reward coupon or when a coupon is expiring soon.

Tavvi does not send marketing or promotional SMS messages. All messages are transactional or informational in nature.

2. How Users Opt In

Users provide explicit, separate opt-in consent during account registration through the Tavvi mobile app. The consent flow works as follows:

Step 1: Account Registration

During sign-up, after entering their phone number, users see a clearly labeled SMS consent checkbox (unchecked by default). The checkbox includes the following disclosure:

Receive text message notifications

I agree to receive order updates and account notifications via text message. Msg & data rates may apply. Reply STOP to opt out at any time.

This checkbox is:

  • Separate from the Terms of Service agreement
  • Optional — users can complete registration without checking it
  • Unchecked by default — requires affirmative action to opt in

Step 2: POS In-Store Registration

When a business creates a customer profile at the point of sale, a clearly labeled SMS toggle is presented with:

Customer agrees to receive text message updates

Staff must obtain verbal consent from the customer before enabling this toggle.

Step 3: Notification Settings

Users can manage their SMS preferences at any time through Account > Notification Settings. The SMS toggle displays:

3. How Users Opt Out

Users can opt out of SMS messages through any of these methods:

  • Reply STOP to any message — processed immediately in real-time
  • Reply HELP to any message — receives instructions on how to opt out
  • In-app toggle — Disable SMS in Account > Notification Settings

Opt-out requests via STOP keyword are processed instantly. The phone number is added to a global opt-out list and no further messages are sent.

Users who have opted out can re-subscribe by replying START to any previous message or by re-enabling SMS in their notification settings.

4. Message Frequency & Content

  • Frequency: Message frequency varies. Typically 1–4 messages per order placed, plus occasional rewards notifications. No recurring scheduled messages beyond a single coupon expiry reminder per coupon.
  • Content: All messages are prefixed with [Tavvi] for sender identification.
  • Footer: All messages include "Reply STOP to opt out" and "HELP for help".

Order placed: [Tavvi] Order #1234 received at Coffee Shop. Total $25.00 (3 items). We'll text you updates. Reply STOP to opt out. HELP for help.

Order preparing: [Tavvi] Your order #1234 is being prepared at Coffee Shop. We'll text when it's ready. Reply STOP to opt out. HELP for help.

Order ready: [Tavvi] Your order #1234 is ready for pickup at Coffee Shop! Please collect within 30 minutes. Reply STOP to opt out. HELP for help.

Refund processed: [Tavvi] Your refund of $25.00 for order #1234 at Coffee Shop has been processed. Allow 5–10 business days. Reply STOP to opt out. HELP for help.

Coupon earned: [Tavvi] You earned a $5.00 reward at Coffee Shop! View it in the Tavvi app. Reply STOP to opt out. HELP for help.

Coupon expiring: [Tavvi] Your $5.00 coupon at Coffee Shop expires in 7 days. Use it before it's gone! Reply STOP to opt out. HELP for help.

5. TCPA Compliance

Tavvi maintains full compliance with the Telephone Consumer Protection Act (TCPA):

  • SMS consent is collected separately from other terms and conditions
  • Consent is recorded with a timestamp (smsConsentAt) on the user record
  • A global opt-out list is maintained and checked before every message
  • STOP/START/HELP keywords are processed in real-time via Twilio webhooks
  • Delivery status is tracked for every message sent
  • No messages are sent to users who have not explicitly opted in

6. Data & Privacy

Phone numbers collected for SMS are used solely for the message types described above. We do not sell, share, or rent phone numbers to third parties.
